If You do not agree to all of these Terms and Conditions of Use, do not use this Platform. Commune Apartment LLP (“We”, “Us”, “Our”) may revise and update these Terms and Conditions from time to time. Your continued usage of the Platform is considered an implied acceptance of the changes and constitutes Your agreement to comply with and be bound by these Terms.

THE TERMS AND CONDITIONS SET FORTH BELOW (THE “Terms”) AS WELL AS THOSE CONTAINED IN THE PRIVACY POLICY GOVERN YOUR ACCESS AND USE OF THE PLATFORM AND ARE LEGALLY BINDING ON YOU. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, PLEASE DO NOT ACCESS OR USE THIS PLATFORM. YOUR USE OF THE PLATFORM SHALL BE DEEMED AS YOUR UNDERSTANDING AND ACCEPTANCE OF THESE TERMS.


Website User Restrictions

All information and materials available on the Platform, including text, images, graphics, trademarks, content, and software (collectively, the “Materials”), are the intellectual property of Commune Apartment LLP or authorized third parties. We grant You a limited, revocable license to view and download Materials only for personal and non-commercial use, provided You retain all document copyright and proprietary notices. You agree not to:

  • Modify, copy, publish, transmit, distribute, reproduce, license, or sell any Materials

  • Use Materials for any commercial purpose without prior written permission from Us

  • Remove or obscure any copyright or trademark notices

This limited license terminates automatically without notice if You breach any of these Terms.


Third‑Party Content

We do not control or endorse third‑party content made available on the Platform. Any opinions, advice, information, or content provided by third‑parties belong solely to such providers. We do not guarantee the accuracy, reliability, or suitability of any external content.


Links to Third‑Party Websites

The Platform may contain links to third‑party websites that are not controlled or operated by Us. We are not responsible for the content, terms, privacy practices, or services of such external websites. If You establish a link to the Platform, You must remove the link immediately upon Our written request.


Feedback

Any feedback or suggestions submitted by You may be used by Us without limitation. Personal data included within feedback shall be handled per Our Privacy Policy.


Changes to Platform & Terms

We reserve the right to modify these Terms and the Platform at any time without prior notice. It is Your responsibility to review the Terms periodically. Continued use of the Platform following changes indicates acceptance.


Termination

We may suspend or terminate Your access to the Platform at any time, with or without cause or notice. Upon termination, You must cease all use of the Platform and destroy any downloaded Materials.


Proprietary Materials Agreement

All Materials are owned by Commune Apartment LLP and are protected under applicable intellectual property laws. Unauthorized distribution, reproduction, or commercial use is strictly prohibited.


No Agency or Partnership

Use of the Platform does not create any agency, joint venture, partnership, or employment relationship between You and Us.


Notices

Notifications may be sent electronically to the email You provide. Notices to the Company must be sent to: [Insert official email].


Entire Agreement & Severability

These Terms, including the Privacy Policy, constitute the entire agreement. If any portion is found unenforceable, the remaining provisions will remain in effect.


Assignment

We may assign any rights or obligations to another entity without prior notice.


Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. You agree to the exclusive jurisdiction of the courts in Gurgaon, Haryana.


Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERROR.


Limitation of Liability

We shall not be liable for any direct, indirect, incidental, consequential, exemplary, or punitive damages arising from use or inability to use the Platform, including loss of data, revenue, or access.


Indemnity

You agree to indemnify and defend the Company and its affiliates from any claims, damages, losses, liabilities, and expenses arising out of Your use or misuse of the Platform.


Terms of Payment

Prior to check‑in, the resident must pay the first month’s fee and full security deposit. In certain locations where rent is collected 3, 6, or 12 months in advance, the full advance must be paid before check‑in. Delay in payment beyond the 10th of each month will incur a penalty of INR 100 per day, added to the next month’s fee.

Booking Amount refers to a non‑refundable amount paid to reserve accommodation. Booking Amount is strictly non‑refundable.


Refund & Cancellation Policy

1. Booking Amount

The Booking Amount paid at the time of reservation is strictly non-refundable under all circumstances. This includes cancellation before check-in, change of mind, or delay in documentation or payment.

2. Security Deposit Refund

A refundable security deposit is collected prior to check-in. The refund will be processed within 7–14 business days after check-out, subject to:

  • Deduction for any pending dues or penalties

  • Deduction for damages, missing items, deep cleaning, or restoration costs

  • Deduction for key/access card replacement costs (if applicable)

The security deposit cannot be adjusted against rent unless explicitly approved in writing by management.

3. Early Exit / Move-Out Before Contract End

If You choose to move out before the agreed lock-in or notice period:

  • The notice period requirement must be fulfilled (typically 30 days unless otherwise specified)

  • If You fail to serve the notice period, an amount equal to one month’s rent will be deducted from the security deposit

  • Advance rental (if paid for longer duration plans) will be refunded only for full unused months; partial month is non-refundable

4. Cancellation After Check-In

If a resident cancels after check-in:

  • Rent for the full notice period must be paid

  • Booking Amount and partially used month rent will not be refunded

5. Service & Maintenance Charges

Any unpaid dues such as electricity, water, damage, restoration, additional cleaning, or community penalties (if any) will be deducted from the final refund before settlement.

6. Mode of Refund

Refunds will be processed only to the original account used for payment. The Company is not responsible for delays caused by banking systems or incorrect account details.

I have been a resident for 4 months now and I am very happy that I chose Commune over other companies that offer serviced apartments. Most important aspect is community living so that it becomes a home away from home. I've really enjoyed watching the T20 WC, IPL and Euro with the bunch of friends together. 2nd aspect is freshly cooked delicious food in our own kitchen. Commune guys, keep up the good work 👍👍

I've been staying in NCR for 5 years now and Commune has been my first time in a co-living . And it has been a far better experience than anywhere I've stayed earlier. With the provision of housekeeping, you'll find a clean room after coming back from work. There will be food for you and you literally do not have to take stress of anything. Everything here is taken care of. The budget is absolutely justified by the amenities they provide. Superb stay!
